1.EXPLAIN THE DOCTRINE OF INFORMED

Healthcare Law
1.Explain the doctrine of informed consent. What does it mean and what is required?

2.You are the risk manager for a hospital, and you are making a speech to doctors and nurses on how to prevent malpractice claims. Draft a speech about the general guidelines for all healthcare providers to follow to limit and reduce their potential liability for malpractice. Provide details and concrete steps they can follow to protect themselves and the organization.

3.Explain the various ways physicians and other healthcare professionals can defend themselves against lawsuits

4.You are a receptionist/greeter in a long-term care facility. Your regular responsibilities require you to monitor the front desk for all visitors. One day, the employee who visits with the patients and pushes the book cart around calls out sick. The director recognizes that the residents enjoy this interaction and asks you to fill in for the day. You happily agree, as it will give you a chance to walk around a little and get away from the front desk for a change. You are visiting with patients and pushing the cart through the halls. You stop to visit with Mr. Thomas and notice that he has bruises on his arms and legs. He is not confined to his bed, but it looks like he may have been at one point. You do not know Mr. Thomas to be violent or a danger to himself or others that would require him to be restrained. When you talk to him, he says he doesn’t like the new nursing assistant and that he misses the previous one. She was much nicer to him. He will not directly say that he was abused or injured purposely, but you suspect that he was.

You are not a medical professional. Do you have the same obligations to report the abuse? What specific steps do you take? Should you come forward even if you have no proof?

When answering the above questions, reference the website for the National Center on Elder Abuse (http://www.ncea.aoa.gov/) and search for “State Resources”. Look up the requirements for reporting elder abuse in your current state of residence. Use the reporting requirements to answer the questions.

5 A nurse is terminated from her position at a hospital after 20 years. She is told that it is due to budget cutbacks. As she is preparing to leave on her last day, she over hears the nurse manager telling the director that she is glad to be rid of her. Because she had been there so long, she was making too much money for the same job a person in their 20s could do. In fact, the nurse manager had already hired a younger worker as an entry-level replacement for at least half the salary the nurse was being paid. The nurse being terminated is 52 years old.

What claims if any can the nurse bring against the hospital? What specific law can she raise to support her arguments? Would she be successful in her claim? Why or why not? What is your opinion? Be sure to include reasons to support your answer.

  1. A supervisory position has opened up due to someone retiring in the medical office in which you work. You and your pregnant co-worker are talking about it at lunch one day, and your co-worker is very excited because she has been told several times that the next supervisory position that came open would be hers. The next day, however, it is announced that someone with less experience and time on the job will be taking over the position instead. Your co-worker feels very strongly that it is because she is pregnant and going on maternity leave in two months. Do you feel that your co-worker has a valid claim against the medical office? Why, or why not? What steps, if any, do you feel she should take next to address this situation? How would she go about proving a violation of the Pregnancy Discrimination Act? Be sure to present reasons to support your answer.
