This is a very interesting topic, indeed. Please refer to my response file (alos presented below). I have provided a suggested outline for your paper, research data and links for further inquiry. I attached some information about the various laws that you might find useful. I hope this helps and take care.

RESPONSE:

I drew up a tentative outline to follow. Saying that, though, it is only a suggestion and, therefore, you can add, delete or make changes as you see fit. I found it easier to respond to this question with this type of organization outline.

Impact of Government Laws and Regulations on Health Care Budgeting
Outline
I. Introduction
II. Government Laws and Regulations: Medicare & Medicaid
(or maybe you would prefer to use the headings Medicare and Medicaid and include the laws and regulations under these titles, but it seemed to work okay this way. You will have to add your own discussion as this is the research part of the assignment)
1. Social Security Act (1965)
2. The Health Insurance Portability and Accountability Act of 1996 (HIPAA)
3. Balanced Budget Act (1997)
4. Implementation of Sections 111, 401, 403, and 405 of the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act (2000)
5. Medicare Modernization Act (2003)
III. Impact of Health Care Budgeting
1. Medicaid’s impact on budgeting
2. Medicare impact on budgeting
IV. Discussion & Conclusion

Laws and Regulations Effecting Health care Budgeting

I. Introduction

Here you will give a brief introduction to your topic and why you think it is important. Why did you choose this subject? If it was an assigned topic, you will still have to think of reasons that this is an extremely important topic to draw in your reader.
No central administration, Health Policy at level of state and local government. Many private insurance plans are subject to control by laws and regulatory bodies at state level, but federal corporate income tax policy and the federal Employment Retirement Income Security Act (ERISA) affect many employer-sponsored plans. Medicare (health insurance for the disabled and people aged over 65) is a purely federal program, administered by the Health Care Financing Administration. National and state governments act in co-operation: Medicaid and Children’s Health Insurance Program for people with low income (http://www.reform-monitor.org/httpd-cache/doc_stq_hc-910.html).

II. Government Laws and Legislature: Medicare & Medicaid

1. Social Security Act (1965)

In 1965, the Social Security Act established both Medicare and Medicaid.
Medicare was a responsibility of the Social Security Administration (SSA), while SSA and SRS administered Federal assistance to the State Medicaid programs, which were agencies in the Department of Health, Education, and Welfare (HEW). In 1977, the Health Care Financing Administration (HCFA) was created under HEW to effectively coordinate Medicare and Medicaid (see http://www.cms.hhs.gov/about/history/hcfacollection.asp). In 1980 HEW was divided into the Department of Education and the Department of Health and Human Services (HHS). In 2001, HCFA was renamed the Centers for Medicare & Medicaid Services (CMS). (Last Modified on Thursday, September 16, 2004).
CMS is the federal agency, which administers the Medicare Program. Currently, Medicare provides coverage to approximately 40 million Americans. Medicare is the national health insurance program for:

· People age 65 or older
· Some people under age 65 with disabilities
· People with End-Stage Renal Disease (ESRD), which is permanent kidney failure requiring dialysis or a kidney transplant (http://www.cms.hhs.gov/medicare/ Last Modified on Thursday, September 16, 2004).

Medicaid is a joint state and federal program that provides medical assistance for those with low income. Medicaid is administered by the state, and jointly funded by the state and the federal government (Title XIX of the Social Security Act) (http://www.cms.hhs.gov/statistics/35chartbk.pdf).

The Medicare and Medicaid programs were signed into law on July 30, 1965. President LBJ is pictured at the signing ceremony in Independence, Missouri at the Truman Library. Former President Truman is seated beside him. LBJ held …
