Everyone’s heard of fantasy sports. Even if you’re not into sports
yourself you probably have those friends that that’s all they talk about. But
the average American probably doesn’t know about the new online daily
fantasy boom. Fantasy sites like DraftKings and Fanduel are spending big
money to change the way people bet on sports and has some people
wondering, is it legal?
In its simplest form, “Daily fantasy allows a player to join any number
of leagues on a given day, pay a small entry fee, construct a lineup and win –
or lose…” (Miceli, 2015, para. 5). Gambling right? Well folks at DraftKings
think not and are standing by their belief that skill is involved when placing
bets and players are making educated decisions based on years of
knowledge. With that argument they are, for the moment, successfully
navigating a loophole in the Unlawful Internet Gambling Enforcement Act of
2006 or UIGEA. The Act in brief “prohibits gambling businesses from
knowingly accepting payments in connection with the participation of
another person in a bet or wager that involves the use of the Internet and
that is unlawful under any federal or state law.” (UIGEA, 2016, para. 1) The
grey area where companies like DraftKings and Fanduel live has to do with
terminology like “skill” or “chance” as described in the UIGEA, “All winning
outcomes reflect the relative knowledge and skill of the participants…”
(109th Congress, 2006, Section 101, (ix) (II) is legal. Whereas “staking or
risking by any person of something of value upon the outcome of a contest
of others, a sporting event, or a game predominantly subject to chance.”
(109th Congress, 2006, Section 101, (6) (A) is not legal. In an NBC Sports article, National Football League commissioner Roger
Goodell stated that the long standing opposition to sports gambling will
continue but that they, (the NFL) don’t lump fantasy football in with
gambling (Wilkening, 2014). In fact Goodell supports it saying, “Fantasy has a
way of people engaging more with football, and they do it in a fun, friendly,
in this case, a family manner” (Wilkening, 2014, para 6). The National
Football League’s support of what some believe is a form of illegal gambling
has some fans questioning their motives, and they should be. The nail in the
coffin may have come when an employee at DraftKings accidentally released
inside information about lineups then won a $350,000 pot not soon after in a
bet with rival company Fanduel. Has the close alliance between the
companies and the NFL created a system that is corrupt before it even
starts? That’s what Harry Reid, former chairman for the Nevada Gambling
Commission wants to know and has requested Congress to review the
legality of daily fantasy sports betting (Gouker, 2015).
If I had to decide for myself if this type of betting was wrong I would
say no but only to a certain line and that line is a very fine line. The bible
doesn’t directly condemn gambling but is very clear that the pursuit of
money is no good as so finely stated in 1 Timothy 6:10 (KJV), “For the love of
money is the root of all evil: which while some coveted after, they have erred
from the faith, and pierced themselves through with many sorrows.”
It is my opinion that the NFL and other leagues are taking advantage of
the millions of dollars these two companies are spending on advertising
while they can before Congress shuts it down for good. There is strong
evidence available to suggest that the systems put in place by these
companies is flawed and already corrupt even if that isn’t their intention,
people have and will take advantage of any system in the pursuit of money.
