Whether you are an adult or a juvenile, if you break the law and get caught, you will go through some type of justice system to the point of conclusion. With juvenile status offenses, most kids are returned to their parents and the parents given a date to appear with the child before the juvenile court.

With the more serious juvenile offenses and all adult serious offenses, there will be a formal arrest and detention and an appearance before a judge to begin the justice process. Bail is granted in nearly all instances except capital crimes and if the charge involves family violence, bail will not be granted until an appearance before a judge.

Instructions

Create one fictional case of armed robbery where the suspect is a juvenile and one where the suspect is an adult. The background of the case is irrelevant for this discussion and you do not need to describe the circumstances of the crime. In both cases, the suspect will be arrested and go through the justice process to the point of being sentenced for the adult or given a disposition for the juvenile.

· Contrast two fictional cases, one juvenile and one adult, at each part of the process as the suspect goes through the justice system.

· Demonstrate which process, juvenile or adult, would be the most preferred from the perspective of the defendant.

Introduction

Congress as well as the states passes laws that affect the entire criminal justice system, adult and juvenile. Court decisions can have as much, if not more, effect on the justice system. Court decisions typically provide mandates for what law enforcement and the courts can and cannot do and what is constitutional and what is not.

Over time, we have seen a far slower evolution of rights apply to juvenile proceedings in comparison to rights that apply in adult proceedings. The rationale behind this can be connected to the differing approaches to juvenile offenders. As perceptions changed throughout history, rights continued to increase in application. It was an evolving process. We still see some key distinctions to date, including in the areas of jury trials and utilization of the death penalty.

Introduction 

Police officers use discretion practically every day. Discretion can have very serious consequences for the police officer and his or her employing agency. An example would be an officer allowing someone who is just over the legal limit to continue driving on a promise that he or she would go straight home. What if the person wrecks his or her car and kills someone on the way home? The potential liability for that officer and the employing agency is tremendous, not to mention the fact that someone’s life was lost as a direct result of that officer’s discretion.

According to Hirby (n.d.), police discretion is defined as “the decision-making authority afforded to police officers that allows them to decide if they want to pursue police procedure or simply let someone off with a warning.” Some common examples of police discretion are domestic violence, traffic violations, potential hate crimes, and crimes involving the mentally ill. The line between discretion and racial profiling can become blurry when police make an assumption, for example, that people of a certain race are more likely to be guilty of crimes (Hirby, n.d.). Keep in mind that officers cannot just use discretion for something like Miranda rights or whether or not to overlook a homicide. Serious incidents and matters involving court decisions should be handled in a procedural manner.
