Coursework: A Legal Brief (as per UK Law) for the following E-crime case. In addition it should highlight three laws (Computer Misuse Act, Data Protection Act & Telecommunication Act) that have been breached and references to case law.
E-crime case (Pls. modify the story {to be looked as real} as per the case and write legal brief about this e-crime case): —–
The story in the news is about the teenager boy who was kidnapped by his accused two friends in Chelmsford because they knew that the father of this teenager boy is very rich and they can demand heavy ransom. Therefore, they plan to trap him. First, they created fake account on Facebook with the pic of smart girl to molest the teenage boy. Then they sent the request from this fake account. The boy was impressed from the profile pic of this fake account and accepted the friend request. They started chatting and ultimately, they call this boy to meet in a quiet location where there is no CCTV. The boy came to the meeting point where his two accused friends were already waiting with the car to kidnap him.
The boys parents went to the police station late midnight to lodge a complaint as their son went out and never return. Police took boys mobile number and start the investigation. They found that his two friends numbers were the last to call him. So they start investigating his two friends. Simultaneously, with the help of cyber security expert, when police open the teenager Facebook account they found that the last request was accepted from profile that belongs to a girl. When they trace this girls account they came to know that her identity (Profile pic) is stolen and used to create the fake account.
On the other hand, police reached the spot where the teenager phone was last switched off and they find his dead body. Later, one witness come to the police informing them that the boys he had seen on that particular night were probably the same two accused boys but due to darkness, he is not 100% sure. All the evidences are against the suspects but they keep denying anything wrong doing as the teenage boy was their best friend.
NOTE: – The task is to defend the accused and create the legal brief for them.
