The Occupational Safety and Health Act of 1970 (OSH Act) is very effective in providing protection for the well-being of workers because the law has requirements that impose standards of safety on the amount of hazardous conditions workers can be exposed to. These include providing fall protection, preventing trenches from caving in, ensuring workers safely enter confined spaces, and placing guards on machines. Workers who face higher than usual exposure to safety hazards because of their job also must receive training. In addition, employers must monitor their safety practices and keep detailed records open for auditing of injuries and illnesses. Therefore, an effective protocol exists for preventing employee injury, but there exists room for improvement (OSHA, 2012).
I would suggest that far tougher penalties be enforced for companies that violate the existing regulation as some companies have several fatalities attributed to their businesses failing to follow OSHA regulations, but are able to still operate. If one fatality is attributed to unsafe and derelict practices, I suggest that OSHA place severe financial penalties on this company. In addition, when companies consistently place workers in harms-way I suggest higher penalties be assessed to those perpetrators to send a message to the industry or other businesses that violating OSHA regulations will result in potential bankruptcy of your business. This would lead to more incentives for companies to practice the safest measures while also training their employees with the best training possible to avoid most occurrences of employee induced accidents.
