Plagiarism is regarded as the activity of attaining credit by acquiring ideas, concepts, formulations, and words of another person by not using references and citations of original author’s name which means not giving credit to them (Louw, 2017). In simple words, the act of plagiarism is nothing but stealing the intellectual property rights of other people without giving credit to them. For instance, consider the famous plagiarism incident Napolitano v. Princeton Univ. that took place in January 1982 453 A.2d 279 (N.J.Super.Ch.Div. 1982), aff’d 453 A.2d 263 (N.J.Super. 1982). Gabrielle Napolitano, one of the top students at Princeton University plagiarized term paper of 12 pages in a Spanish class from one of the library books. She cited that book in five footnotes and did not include references in the text of paraphrased material along with not including indicia of quotations for various verbatim quotations. When she submitted the term paper, the professor detected that it was plagiarized as he was familiar with that book. She was punished by the university discipline commission by delaying her bachelor’s for a year (Kaplin & Lee, 2011). The trial court affirmed that Napolitano had plagiarized by scrutinizing the evidence provided by Princeton university committee. An argument of defending this plagiarism incident is that Napolitano used plagiarized content without any false intentions. In some cases, plagiarism occurs purely accidental and it causes the failure of referencing in a proper format. Improper referencing and paraphrasing content of other authors without giving credit is the common mistake that is not done intentionally and has to be considered as human error. One of the arguments offending plagiarism is that plagiarism exhibits character flaws and that offenders probably like to misconduct themselves in legal practices and them admission must be deferred or it has to be refused. Whether it may be intentionally or unintentionally, plagiarizing other’s intellectual property for attaining credits is ethically wrong as well as legally wrong.

One common instance of plagiarism or using someone else’s intellectual property that you are familiar with is copying directly from the original sources. This basically involves inclusion of more than one sentence from the original text directly into your work with or without footnotes and is not acceptable. In fact it literally means that you have not made any contribution in terms of originality to your work and therefore you cannot get away with because you have directly copied another person’s work from a journal, book, article, and websites without proper referencing.
