Topic: The Family and Medical Leave Act

The Family Medical Leave Act (“FMLA”), a federal law, provides eligible employees with 12 weeks of unpaid leave during each 12-month period of time to use in connection with the: (1) birth or adoption of a child; (2) care of a child, spouse, or parent with a “serious medical condition; or (3) care of the employee’s own “serious medical condition.” Recent amendments apply to cases involving “military caregiver leave.” The New Jersey Family Leave Act (“NJFLA”) provides for 12 weeks of unpaid leave during each 24-month period. Many provisions of the State law are similar to the FMLA. However, under New Jersey’s law, no leave rights are provided for an employee to care for his or her own serious medical condition.

The Gerety case involves the plaintiff’s claim under the N.J. Law Against Discrimination that the employer’s unpaid medical leave policy resulted in disparate impact discrimination against women. Notably, the policy in question provided for 26 weeks of unpaid medical leave, which is more than twice as the law requires under either the FMLA or NJFLA.
