THE CASE STUDY: ANNA ROBIC GYM
Boris and Catherine, two friends aged 17, recently visited Anna Robic Gym, a gym
and health club in Kempston. They went there to take advantage of a special
introductory package for new clients.
After they had used the gym and the swimming pool, a member of staff told the
friends that as part of the introductory package, they could also use the gyms
tanning booth at half price. The staff member told them that within the tanning
booth there were a variety of sunbeds and spray tan machines available. The
friends decided to go to the tanning booth area but saw a small notice on the
entrance door saying “Adults only”. Catherine looked particularly young for her
age, so Boris and Catherine quickly showed the member of staff fake ID cards
(stating they were both 18). However, the staff member, without looking at the
cards, said “Weve never been asked to check those”. She then ushered Boris and
Catherine through to the tanning booth area.
Boris used the “stand up” UV tanning booth. He decided not to use the protective
eyewear provided by the Gym. Catherine chose to use the electric spray tan
machine.
After having used the tanning booth Boris went to wait for Catherine in the private
room reserved for users of the tanning booths. The room was part of the area
where the booths were located. Here Boris met David, a 16 year old member of
staff who was folding and restocking the towels. Boris knew David from college
and they talked whilst he waited for Catherine to join him in the private room.
When she arrived, they both went home.
The following morning, Andrew and Robina Lempstone, the owners of Anna Robic
Gym, received telephone calls from the irate parents of Boris, Catherine and
David. Catherines skin had turned orange overnight and she had to stay at home,
unable to attend her college course. Boris had been taken to hospital with burns
around his eyes.
The nurse who had treated Boris at the hospital was Davids mother and she was
horrified to discover from Boris that David, her 16 year old son, was working in the
sunbed area at Anna Robic Gym.
The parents have indicated that they are considering making a formal complaint
against Anna Robic Gym. As the owners of the Gym, Andrew and Robina
Lempstone have sought legal advice in respect of the Sunbeds (Regulations) Act
